Data Masterclass Membership Terms and Conditions

The Data Masterclass Membership ("Membership") is an annual subscription service that provides access to training, coaching, and advisory services related to data, analytics, and AI.
The Membership is available to individuals, teams and organizations seeking to transform their data capabilities.
Membership benefits are outlined in the membership brochure and on the Borek Data Masterclass website.

The Membership fee is payable annually in advance unless otherwise agreed in the offer document.
The payment is due within 30 days of the invoice date.
Payment can be made by bank transfer.
Failure to make timely payments may result in suspension of Membership benefits.

Membership benefits include access to online courses, live events, coaching sessions, and advisory services and are outlined in the offer.
The specific benefits and their availability are subject to change at the discretion of Borek Data Masterclass.
Members are responsible for ensuring they have the necessary equipment and resources to access and utilize the Membership benefits.

All intellectual property rights in the Borek Data Masterclass training materials, frameworks, and other content remain the property of Borek Data Masterclass.
Members are granted a non-exclusive, non-transferable license to use the content for their internal purposes during the Membership term.

Both Borek Data Masterclass and Members may have access to confidential information during the Membership.
Borek Data Masterclass agrees to maintain the confidentiality of all non-public information disclosed by Members in the course of coaching, advisory, or community interactions, and not to disclose it to any third party without prior written consent, unless required by law.
Members agree to hold in confidence any non-public information of Borek Data Masterclass or other Members, and not disclose it to third parties without prior written consent.
Confidentiality obligations do not apply to information that (i) is publicly available, (ii) was known prior to disclosure, (iii) is independently developed without access to confidential information, or (iv) must be disclosed under legal obligation.

Borek Data Masterclass will use reasonable efforts to provide the Membership benefits in a professional and timely manner.
To the fullest extent permitted by law, Borek Data Masterclass shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the Membership.

The Membership automatically ends after 12 months without need for cancellation unless the member is signing a renewal contract.
It cannot be terminated by either party beforehand.
We will contact you two months before to discuss renewal terms.

These terms and conditions shall be governed by and construed in accordance with the laws of Germany.
Any dispute arising out of or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts of Germany.

These terms and conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

Borek Data Masterclass reserves the right to amend these terms and conditions at any time by posting the revised terms and conditions on the Borek Data Masterclass website.
Members are responsible for regularly reviewing the terms and conditions to stay informed of any updates.
